Terms of Services

1. Business Customers Only

Sharkslap Audio memberships are available exclusively to businesses, agencies, freelancers, self-employed professionals, and other commercial entities.

By purchasing a membership, you confirm that you are acting in the course of a business, trade, profession, or self-employed activity and not as a consumer.

2. Membership Plans

Sharkslap Audio offers the following membership plans:

Business Starter

• Up to 10 downloads per calendar month

• Commercial use for owned business channels

• Social media content (organic)

• Websites and podcasts

• Internal and external business communications

Business Pro

• Up to 50 downloads per calendar month

• All Starter features

• Paid advertising campaigns

• Recruiting campaigns

• Image films and promotional videos

• Client projects

Agency+

• Unlimited downloads

• All Business Pro features

• Use for clients actively managed by the subscribing agency

• No redistribution of music files to clients

Unused downloads do not roll over to future billing periods.

3. License Grant

During an active membership, Sharkslap Audio grants a non-exclusive, non-transferable license to use downloaded music within the scope of the purchased membership plan.

All copyrights and ownership rights remain with Sharkslap Audio and its licensors.

4. Restrictions

Users may not:

• Resell music files

• Redistribute music files to third parties

• Upload music to stock music platforms

• Create competing music libraries

• Use music files for AI training purposes

• Share account credentials with unauthorized users

  
  

5. Subscription and Billing

Memberships are billed in advance on a recurring basis.

Subscriptions automatically renew unless canceled before the next billing cycle.

Prices are displayed exclusive of applicable taxes unless otherwise stated.

6. Cancellation

Members may cancel their subscription at any time.

Cancellation takes effect at the end of the current billing period.

No partial refunds are provided for unused membership periods.

7. Previously Published Projects

Projects created and published during an active membership may remain online indefinitely after cancellation.

However, no new projects may be created using Sharkslap Audio music after membership termination.

8. Refund Policy

All membership fees are non-refundable once access to the Sharkslap Audio library has been granted.

9. Service Availability

Sharkslap Audio will use reasonable efforts to maintain service availability but does not guarantee uninterrupted access.

10. Limitation of Liability

To the maximum extent permitted by law, Sharkslap Audio shall not be liable for indirect, incidental, consequential, or special damages arising from the use of the service.

11. Governing Law

These Terms shall be governed by the laws of the Federal Republic of Germany.
